1. Scope

These Terms and Conditions of Sale apply to all purchases made through the website operated by L’Escale Art (“the Seller”).

By placing an order, the customer (“you”) agrees to be bound by these terms.

2. Products

All products are made to order and fulfilled by our partner, Printful.

Product descriptions and images are provided for informational purposes.
Due to the nature of printing, slight variations in:

  • colors
  • positioning
  • scale

may occur and do not constitute defects.

3. Prices

Prices are displayed in the selected currency and include applicable taxes where required.

Shipping costs are calculated at checkout.

The Seller reserves the right to modify prices at any time. However, products are billed at the price in effect at the time of order confirmation.

4. Orders

An order is considered final once payment has been successfully processed.

The Seller reserves the right to refuse or cancel any order in case of:

  • suspected fraud
  • incorrect information
  • payment issues

Once production has started, orders cannot be canceled or modified.

5. Payment

Payments are processed securely via Shopify and its payment providers.

We do not store any payment details.

6. Production & Delivery

All items are produced and shipped by Printful.

Production time: typically 2–5 business days
Shipping time: varies depending on destination

Delivery times are estimates and may be affected by:

  • carrier delays
  • customs processing
  • peak periods

7. Right of Withdrawal

Due to the custom, made-to-order nature of our products, the right of withdrawal does not apply, in accordance with Article L221-28 of the French Consumer Code.

8. Returns & Claims

Returns and exchanges are not accepted except in cases where the product is:

  • damaged
  • defective
  • incorrectly fulfilled

Claims must be submitted within 14 days of delivery and must include:

  • order number
  • photographic evidence

We will work with Printful to offer a replacement or refund where applicable.

9. Shipping Issues

The Seller is not responsible for:

  • delays caused by carriers
  • customs fees or import taxes
  • lost or stolen packages marked as delivered

Customers are responsible for providing accurate shipping details.

10. Ownership & Risk

Ownership of the product transfers to the customer upon full payment.

Risk transfers upon delivery of the goods.

11. Intellectual Property

All designs, visuals, and content are the exclusive property of L’Escale Art.

Any reproduction or use without authorization is prohibited.

12. Liability

The Seller shall not be held liable for indirect or consequential damages resulting from the purchase or use of products.

13. Governing Law & Disputes

These Terms are governed by French law.

In case of dispute, an amicable solution will be sought before any legal action.
